He was arrested, booked, fingerprinted, and formally charged on 37 counts then released on the condition that he avoid contact with potential witnesses in his upcoming trial.

Biden returned the documents before they even know they were gone and he was the one who told them he had them. Trump refused to return the documents when they were requested back and he is caught on tape admitting to knowing he wasn't supposed to have them. Also he asked his lawyers to destroy evidence.

Huge difference between a crime with someone cooperating and someone who tries to destroy evidence. Also the content of trump's documents seem like they're higher level and more highly classified.

the Justice Department recommended the defendants be released with no financial or special conditions as they aren't a "flight risk."

I'd like to see him manage to wiggle his way out of this one. I'm not American so I'm not familiar with the systems in place and all, but from everything I've seen, well... it's not looking good for him. At all.

But honestly, with Trump legendary incompetence and ability to keep on digging his own grave, I'm barely here for the politics, this is just good entertainment at this point. Even if I know that while this is funny, this will probably be remembered as anything but.

I don't think he can actually get out of this one, but he can still litigate it to hell and back. It will depend on which judges his various challenges land in front of and what their capacity for his bullshit is. But he's 77 and eats garbage and doesn't exercise. Very real possibility he just croaks before he ever sees the inside of a cell.

I work with many people who are so upset over this, calling it injustice and how horrible that we choose to prosecute Trump when we should instead be jailing Hillary, Harris, and Biden.

I bite my tongue and don’t say anything but it’s so frustrating.

As far as Hillary goes I am not sure why Trump's DoJ didn't hand down an indictment if it had evidence that she ultimately committed a crime? I guess the same is true for Hunter.

I am from Poland and didn't really follow the whole case. Can someone explain me why there is a thread that he will be arrested? It is hard to find the origin as the whole case exploded.

There's a LegalEagle video which sums it up: Trump's Bombshell Federal Document Indictment

Essentially,

  • Trump took classified information during his time as president and failed to return them
  • When asked to return them he failed to comply until forced
  • When forced to comply, he still kept many documents the government knew were missing and lied to the government and his lawyers indicating that they were returned
  • Was caught on tape admitting that he knew they were classified and that it was wrong for him to have them

The first bullet point apparently happens often (Biden, Pence, Hillary have all done similarly in the past). Trump is singular in that he didn't readily comply with the request for the return of documents and the consequent lies to the government (also illegal).

He took top secret documents when he left the white house. They don't belong to him, they're meant to be secured in the library of congress or something. Anyway, librarians tried to get them back, he said no, did a bunch of illegal shit (including flashing them around people he wanted to impress) so FBI got involved, raided his place, found more secret documents, special prosecutor was appointed who took ages really nailing the iron clad case together. Now he been arraigned in court facing federal charges. Because Trumps a dumb shit.

The vast majority of federal cases end with a plea deal. Any idea if that could include forfeiting any right to run for public office? Would be great for peace of mind if so
