Lets face it. If this case gains any traction. It is pretty darn clear that thos was not the original intent of the law. The EU and UK will change the law long before they ban closed source software.
It is just not economically viable for them to interact with the rest of the world.
Best it can achive is a rewording of the law to clearify stoeage vs manipulation of data. And give. The law makers are not particularly concerned with OS software. The OS community is unliklt to see any advantage.
