Disney is asked to show some compassion over the use of Spider-Man's image on a child's grave.

For those that aren’t reading the article, it has nothing to do with copyright.

A representative from Disney said the decision had been made as a result of a policy that started with Walt Disney himself which does not permit the use of characters on headstones.

Disney has since told the Jones family it would be happy to provide them with a hand-inked, personalised commemorative cel for Ollie, who died from leukodystrophy.

They would never have needed to ask Disney for permission without copyright, and they could put whatever they want on the headstone whether Disney liked it or not.

I also don't buy blaming a dead dude for the policy, or that Walt didn't consider how copyright law works when making the decision.

I despise Disney but I think this is just a simple corporate copyright law problem. Disney is not gonna give explicit permission to use any of their brands, for anything that is not under a contract. But I don't think they will go after them if they use it.

I actually agree with that decision. Fuck Disney but if Disney started selling headstones people would be in a uproar over it as well. They would call it inappropriate and everything. And while in this case the stone wouldn't be sold by Disney, the design would still be out of place.
