wo ich kurz nach Passieren des Schildes von meiner Beifahrerin verständnislos gefragt wurde, warum ich denn hinter dem Fahrrad mit Kinderanhänger bliebe, statt endlich zu überholen, es sei ja genug Platz.

Die abgebildeten Überholmanöver sind legal, da die Radfahrenden den Seitenstreifen statt die Fahrbahn benutzen. Es handelt sich somit um Vorbeifahren.

Wer ein langsameres Fahrzeug führt, muss die Geschwindigkeit an geeigneter Stelle ermäßigen, notfalls warten, wenn nur so mehreren unmittelbar folgenden Fahrzeugen das Überholen möglich ist. Hierzu können auch geeignete Seitenstreifen in Anspruch genommen werden; [...]
Das halte ich für genau diese Situation: Langsames Fahrzeug fährt auf geeignetem Seitenstreifen.

Und jetzt erklär mir bitte mal für blöde, wieso jemand, dem ich das Überholen ermögliche, gar nicht überholt, sondern vorbeifährt.

Überholen gibt es im rechtlichen Sinne nur zwischen Verkehrsteilnehmenden, wenn beide auf Fahrbahn in dieselbe Richtung fahren. Radfahrstreifen (nicht Schutzstreifen), Radwege und Seitenstreifen sind nicht Teil der Fahrbahn. Die Straßenverkehrsbehörde hätte einfach zusätzlich die Verlegung der Fahrbahnbegrenzung VZ 295 an den äußersten rechten Rand anordnen sollen.

VZ 277.1 habe ich bisher nur an Stellen gesehen, wo das Überholen ohnehin wegen des nicht einzuhaltenden Mindestabstands verboten wäre. Dort ist es damit überflüssig und nach §45(9) StVO nicht zulässig.
@[email protected] "Es gibt ja schon eine Regel, an die sich nur alle halten müssen" gilt ja dem Prinzip nach auch für die durchgezogene Linie in engen Kurven. Redundant, weil ohnehin ein Überholverbot in schlecht einsehbaren Kurven besteht. Wird trotzdem gerade dort eingesetzt.

Also links von der rechten Begrenzungslinie. Die Dame auf dem Bild fährt aber rechts davon und damit außerhalb der Fahrbahn. Oder?

In der Mitte der Fahrbahn ist eine durchgezogene Linie. Mit welchem Auto willst du da die 2 m vorgeschriebenen Überholabstand einhalten ohne die durchgezogene Linie zu überfahren?

Trotzdem dürfen sie nicht überholt werden, nach den letzten Verlautbarungen gilt auch der Fahrradstreifen als Teil der Fahrbahn.

Allerdings ist es dann kein Überholvorgang, wenn das Auto vorbeifährt - genau: weil überholt wird nur, wer auf der Fahrbahn fährt ...

Interessiert mich jetzt nur, ob für diesen Fall auch Vorbeifahr-Abstände festhalten sind - denn unerwartet stürzen kann ich auch auf so einem Seitenstreifen…

Aber nicht wenn er auf dem Radweg fährt - auch wenn der genauso schmal ist wie der Schutzstreifen ist.
Auch nicht wenn der Radfahrende nicht auf der Fahrbahn sondern knapp daneben färht
Gehört geändert, in : Beim Überholen oder Vorbeifahren an einem sich bewegenden Zweirad ist generell ein MindestAbstand von 1,5 /2,0 m einzuhalten.

Aber ihr glaubt doch nicht dass das für irgendeine autofahrende Peron einen unterschied macht.
Ich hätte in beiden Fällen NICHT überholt und wer überholen will wird es auch tun wenn die Radler*innen links des rechten Begrenzungsstreifens fahren.
Es gehört noch ins Gesetz, dass auch beim vorbeifahren 1,5 m einzuhalten sind.

Trotz gleicher Seitenabstände und gleicher Gefährdungslage bzw. -Gefühl stellt eine durchgezogene Linie eine rechtlich andere Situation her.
Das ist genau das, was der Spruch "Farbe ist keine Infrastruktur" kritisiert.
