"As he is driving over the nest, the parents of the chicks were squawking and flapping their wings in a futile attempt to prevent it," Mr Christensen said.
In interviews with Parks and Wildlife officers, the man said he wanted to move the birds away from the vacant lot for "development reasons".
Parks and Wildlife said the three chicks were masked lapwing plovers and would have naturally moved from the area in a matter of weeks.
Masked lapwings are a protected native species that build nests on the ground, where they guard their chicks for about six weeks.
After a lengthy investigation involving Parks and Wildlife, RSPCA and witnesses, the man received a "formal warning" and a $718 fine.
