Hi there,
Asking for a friend who doesn’t use Reddit. She is an EU citizen.
She has recently been laid-off (permittert?) on a temporary basis. She will be paid 62% of her salary by NAV.
She is currently owed 48 hours of overtime. Her contract states that she gets +20% in addition to her normal hourly rate for overtime pay. Her contract also states that the employer can ASK to take the time off or pay it out but she is unsure if ultimately, that should be her decision.
She has a few questions:
- Is the 20% overtime rate normal or should it be 40%?
- Can the employer ask her to take the time off? What if she prefers to be paid out?
- Now that she is laid off, what happens to her overtime allowance?
- As an EU citizen, is she entitled to legal aid for this type of issue?
