Point to a current day governmental system where the government doesn't control access to land. One, I'll wait.

Wrong. Ask a biblical scholar morality is man made. Take job or abraham for instance, they stopped where their personal morality told them to not when god said to. Ie. Morality is perception through personal conscious not what is read from pages or dictated from on high.
